The following Terms and Conditions relate to the use of Hooked On Nutrition website (“site”, Services”, “terms”) (www.hookedonnutrition.com.au). The Terms of Use constitute an agreement between Deborah O’Neill (ABN 50 722 032 197) trading as Hooked on Nutrition (“we”, “us”, “our”) and any user of the site and/or services (“you”, “your”, “client” and “user”).  

Access to and use of this Website, and/or any services and/or goods available through this Website (collectively, the “Services”) are subject to the following Terms and Conditions. By using our Services, you are agreeing to the Terms and Conditions set out by Deborah O’Neill. These Terms and Conditions may be updated without notice to you so it is advised that users refer back to these Terms and Conditions regularly to note any changes. If you do not agree to all of the Terms and Conditions of this agreement, then you may not access the website or use any of its Services. 

The information contained in this Website is for general information purposes only. While we endeavour to keep the information up to date and correct, we make no representations or warranties of any kind, expressed or implied, about the completeness, accuracy, reliability, suitability or availability with respect to the website or the information, products, services, or related graphics contained on the website for any purpose. Any reliance you place on such information is therefore strictly at your own risk. None of the content or products offered on our site is meant to diagnose health or medical  conditions. We reserve the right to alter, update, or remove any of our services at any time without notice

TERMS OF SALE

By placing an order for any goods or services from us regardless of the platform of which they were purchased  you are offering to purchase the goods or services on and subject to the following terms and conditions. All orders are subject to availability and confirmation of the order price.

When placing an order you warrant that you are over 18 years of age or are the parent or legal guardian on behalf of the person under 18 years of age, all details you provide to us are true and accurate and that you are an authorised user of the credit or debit card used or bank transfer to place your order and that there are sufficient funds to cover the cost of the goods.

Full payment must be made and the funds cleared into our nominated account, one (1) working day prior to your appointment or program commencement date.

All prices quoted are valid in Australian dollars (AUD) and inclusive of GST (Goods and Services Tax).

For Singapore-based clients payment accepted via UOB bank deposit, secure online facility or Paynow. Foreign currency conversion will be applied using the advertised rate based on the date of invoice.

For Australian-based clients payment accepted via direct deposit or secure online credit card facility.

For clients based in other countries payment accepted via secure online credit card facility.

Any discrepancies in fee amount due to currency conversion will be bore by the client.

Any additional charges or fees incurred from the use of any payment platform used for the purchase with a credit card or international currency will be bore by the client.

Nutrition packages are valid for 12 months from date of purchase.

Single consultation service purchases are valid for 6 months from date of purchase. 

No refunds are offered if clients change their mind after completion of their consultation.

The Friends of TPC, Glenhaven package offer valid until 11.59pm 15th June 2023. The free gift of one of either the Hooked on Nutrition mug or tote bag will be presented to client after completion of both consultations from the package. The free gifts are limited amounts and only available whilst stocks last. The Friends of TPC package is only available to clients and family members of The People’s Chiro clinic, Glenhaven.

100% of the consultation fee will be charged if cancellation is within 24 hours of the scheduled appointment.

100% of the consultation fee will be charged if client is a no-show for the appointment. No-show is defined as when the client has not attended the appointment within the first ten (10) minutes of the appointment time. No-show appointments are considered cancelled by the client AND a minimum of 24 hours notice has not been fulfilled. 

Prices are subject to change without notice.

Each payment processing platform have their own terms and conditions that govern third-party payment processors as such we are not liable or responsible for the application of their terms of use.

DELIVERY OF SERVICES

Online Consultations will be delivered through either Zoom or Google Meet online video conferencing platforms. 

Personalised programs or resources or nutritional advice purchased as a service will be delivered via a nominated email address of the client. Additional information can be obtained by contacting us by email hello@hookedonnutrition.com.au 

DISCLAIMER OF LIABILITY

The information on this Website is not intended as medical advice. Always check with your Medical Practitioner  before embarking on any health program or using nutritional supplements. Check labels for full ingredients list and use only as directed. If symptoms persist consult your Medical Practitioner.

Deborah O’Neill, our affiliates, directors, employees, agents or assigns, to the extent permissible by law, exclude all liability, for any damages whatsoever arising out of, or in any way related to, the use of this Website and/or services. We accept no responsibility for the accuracy, completeness or timeliness of the information on this website.

You may link to our home page, provided you do so in a way that is fair and legal and does not damage our reputation or take advantage of it, but you must not establish a link in such a way as to suggest any form of association, approval or endorsement on our part where none exists.

SECURITY OF INFORMATION

Whilst we strive to protect personal information and data provided by the client, no data transmission over the internet can be guaranteed as completely secure. As such, we do not warrant and cannot ensure the security of any personal information or data which you have transmitted to us and you do so at your own risk. Nevertheless, we will take reasonable steps to protect the security of such information.

INDEMNITY

You agree to indemnify, defend and hold harmless Deborah O’Neill, our directors, officers, employees, consultants, agents, and affiliates, from any and all third party claims, liability, damages and/or costs (including, but not limited to, legal fees) arising from your use of this Website in breach of these Terms and Conditions. These Terms and Conditions are governed by and will be construed in accordance with the laws of New South Wales (NSW), Australia and you submit to the non-exclusive jurisdiction of the courts of NSW, Australia.

The above Terms and Conditions constitute the entire agreement of the parties and supersede any and all preceding and contemporaneous agreements between you and Deborah O’Neill.
